According to the Family code of Ukraine, divorce in Ukraine can be filed in the registry office or the local courts.

At the same time, you can get divorce through the registry office upon mutual consent of the parties, as well as the absence of common children under the age of majority. The parties submit a general application to the registry office. During one-time personal visit to the registry office, each of the spouses expresses a desire to dissolve the marriage in writing. If the couple does not withdraw their application during a month, the registry office will divorce them and give them a certificate according to family law in Ukraine.

How to divorce in Ukraine? It is necessary to go to court if the spouse does not support decision to divorce and the procedure should be held without consent. The consent of the spouse in Ukraine is not mandatory for getting a divorce.

Also, the divorce law provides the proceeding of reconciliation of the parties for a mandatory period. It is one month in the registry office, and from one to six months in court. So, the minimum period for which you can get divorce in Ukraine is one month. If there are related property disputes or if one of the parties is a foreign citizen in Ukraine, divorce through the court may be delayed up to a year or more. That is why family lawyers recommend filing a claim for divorce separately from a claim for division of property.

If you want to get divorce, you should submit the following documents to the registry office:

  • marriage certificate (original or duplicate);
  • passports of spouses.

If the decision is be made in court, the documents required will be:

  • marriage certificate (original or duplicate);
  • passports of spouses;
  • statement of claim;
  • birth certificates of children;
  • alimony contract.

The final official document verifying the fact of the break of family relations is the divorce certificate issued by the registry office. If the divorce process was carried out through the court, the court decision will confirm the divorce.

When divorce is prohibited, the law establishes a procedure of categorical prohibition on the dissolution of the marriage on the initiative of a spouse whose wife is pregnant or who is raising a child up to one year. The exception is when the question of the fatherhood of the child is challenged in court.
